Terms of Service

Minimum Age Requirement

You must be at least 18 years of age to use our services, register for programs, or create an account. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms of Service.

Account Creation and Security

When creating an account with Awaken Guardians, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your information to keep it accurate and current
• Keep your password secure, confidential, and not share it with others
• Use a strong, unique password that you do not use for other services
• Notify us immediately of any unauthorized access to your account or security breach
• Accept full responsibility for all activities that occur under your account
• Not create an account using false information or on behalf of someone else without permission
• Not transfer, sell, or share your account with another person

We reserve the right to suspend or terminate accounts that violate these requirements or that we believe to be fraudulent or created in bad faith.

Account Termination by User

You may terminate your account at any time by contacting us at support@awakenguardians.org. Upon termination, you will lose access to your account and any associated content, course progress, or certifications.

Permitted Uses

Our services are provided for lawful purposes only. You may use our services to:

• Access educational content and training programs
• Participate in courses and earn certifications
• Connect with other members of our community
• Access resources and materials for personal or professional development
• Make donations to support our mission
• Purchase books and other educational materials

Prohibited Activities

You expressly agree NOT to:

• Use our services for any illegal, fraudulent, or unauthorized purpose
• Violate any local, state, national, or international laws or regulations
• Infringe upon or violate the intellectual property rights of others or Awaken Guardians
• Harass, abuse, threaten, or intimidate other users or staff members
• Submit false, misleading, or deceptive information
• Impersonate another person or entity
• Transmit any viruses, malware, or other harmful code
• Interfere with or disrupt the security, integrity, or functionality of our services
• Attempt to gain unauthorized access to our systems, networks, or data
• Use automated systems, bots, or scripts to access our services
• Collect or harvest information about other users without their consent
• Reproduce, duplicate, copy, sell, or exploit any portion of our services without permission
• Share your account credentials or access with unauthorized individuals
• Distribute, redistribute, or resell our course materials or content
• Use our services to promote competing services or businesses
• Engage in any activity that could damage our reputation or business

Enforcement

Violation of these acceptable use policies may result in immediate termination of your account, removal of content, and potential legal action. We reserve the right to investigate violations and cooperate with law enforcement authorities as necessary.

Program Enrollment

When enrolling in our training programs or courses, you agree to:

• Complete payment as required for the program before accessing content
• Participate actively, honestly, and respectfully in all program activities
• Complete assignments, quizzes, and assessments as required
• Respect other participants and maintain a positive learning environment
• Not share, distribute, or reproduce program materials without explicit permission
• Use the knowledge gained for ethical and lawful purposes

Course Access and Duration

Unless otherwise specified, access to course materials is granted for the duration stated at the time of enrollment. Some courses may offer lifetime access, while others may have time-limited access. We reserve the right to modify, update, or discontinue courses at any time, though we will make reasonable efforts to provide notice and alternatives when possible.

Certifications and Credentials

Certifications are awarded upon successful completion of program requirements, including passing grades on assessments and completion of all required activities. Certifications issued by Awaken Guardians represent completion of our training programs but do not constitute professional licenses or credentials unless explicitly stated. You agree not to misrepresent the nature or scope of any certification earned through our programs.

Intellectual Property Rights

All content, materials, and resources provided through our programs, including but not limited to text, graphics, images, videos, audio recordings, software, course materials, curriculum, assessments, and training materials, are the exclusive property of Awaken Guardians and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works, publicly display, publicly perform, republish, download, store, transmit, or sell any of our content or materials without our express written permission. You are granted a limited, non-exclusive, non-transferable license to access and use course materials solely for your personal educational purposes.

Educational Purpose and Disclaimers

Our programs and services are educational in nature and are designed to provide information, knowledge, and skills related to trauma-responsive approaches and related topics. Our services do not constitute:

• Professional counseling, therapy, or mental health treatment
• Medical advice or healthcare services
• Legal advice or legal services
• Licensed professional credentials or certifications (unless explicitly stated)
• A substitute for professional training required by regulatory bodies

We strongly recommend consulting with appropriate licensed professionals for specific situations requiring professional expertise. If you are in crisis or experiencing a mental health emergency, please contact emergency services or a mental health crisis line immediately.

Program Modifications

We reserve the right to modify program content, structure, requirements, or pricing at any time. Changes to active enrollments will be communicated in advance when possible, and we will honor the terms in effect at the time of your enrollment for the duration of that specific program.

Payment Terms

All fees for programs, courses, materials, and services are due at the time of enrollment or purchase unless otherwise specified. By providing payment information, you represent and warrant that:

• You are authorized to use the payment method provided
• The information you provide is accurate and complete
• You will maintain sufficient funds or credit to cover the charges
• You will promptly update your payment information if it changes

We accept payment through secure third-party payment processors. You are responsible for all charges incurred under your account, including applicable taxes and fees.

Pricing and Fees

Prices for programs and services are displayed on our website and are subject to change at any time. We reserve the right to modify pricing, offer promotional discounts, or discontinue products or services. Price changes will not affect enrollments or purchases already completed unless required by law.

Refund Policy

We want you to be satisfied with our programs. Our refund policy is as follows:

• Refund requests must be submitted in writing to support@awakenguardians.org within 14 days of program enrollment or purchase
• We will review refund requests on a case-by-case basis considering the circumstances
• Refunds may be prorated based on program completion and materials accessed
• Once significant program materials have been accessed or downloaded, partial refunds may apply
• Completed certifications or programs are generally not eligible for refunds
• Refunds will be processed using the original payment method within 10-15 business days of approval

Special circumstances, such as technical issues preventing access to programs, will be handled individually. Please contact us to discuss your specific situation.

Donations

All donations made to Awaken Guardians are voluntary contributions to support our mission and programs. Donations are generally non-refundable unless otherwise required by law. We will provide receipts for tax purposes where applicable. Please consult with a tax professional regarding the deductibility of donations.

Book Orders and Physical Products

Orders for physical products, including the TRA Matters book, are processed through third-party fulfillment services. Shipping times, costs, and policies are provided at the time of purchase. Refunds or exchanges for physical products follow the policies of our fulfillment partners and must be requested within 30 days of receipt. Products must be in original condition to be eligible for return.

Content You Submit

Our services may allow you to submit content, including comments, feedback, testimonials, forum posts, assignments, or other communications. By submitting content, you:

• Grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for operational, promotional, and educational purposes
• Represent and warrant that you own or have the necessary rights to the content
• Represent that the content does not violate any laws or infringe on the rights of others
• Understand that your content may be viewed by other users or the public
• Agree not to submit confidential or proprietary information that you do not wish to be public

Content Standards

All content you submit must comply with the following standards:

• Be respectful, professional, and appropriate
• Not contain hateful, threatening, or discriminatory language
• Not include personal attacks or harassment
• Not contain explicit, obscene, or offensive material
• Not include spam, advertising, or promotional content without permission
• Not violate the privacy or rights of others
• Not contain false or misleading information

Content Moderation

You are solely responsible for the content you post. We reserve the right, but have no obligation, to monitor, review, edit, or remove any content that violates these terms or that we deem inappropriate, offensive, or harmful. We may also suspend or terminate accounts of users who repeatedly violate our content standards.

Service Disclaimer

Our services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that our services will be uninterrupted, error-free, secure, or completely free of bugs or viruses.

No Professional Advice

The information and content provided through our services are for educational and informational purposes only and should not be construed as professional advice. We make no representations or warranties regarding the accuracy, completeness, or reliability of any content. You should not rely solely on our content for making decisions and should consult with appropriate professionals as needed.

Limitation of Liability

To the fullest extent permitted by applicable law, Awaken Guardians, its officers, directors, employees, agents, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenues, data, use, goodwill, or other intangible losses
• Any damages resulting from your use or inability to use our services
• Any damages resulting from unauthorized access to or alteration of your content
• Any damages resulting from the conduct or content of third parties
• Any damages resulting from errors, mistakes, or inaccuracies in content
• Any personal injury or property damage resulting from your use of our services

In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount paid by you to us in the twelve (12) months preceding the claim or one hundred dollars ($100), whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless Awaken Guardians and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of our services, violation of these Terms, or infringement of any rights of another party.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States and the state in which Awaken Guardians is primarily located, without regard to its conflict of law provisions.

Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or our services, you agree to first contact us at legal@awakenguardians.org to attempt to resolve the dispute informally. We will work in good faith to resolve any disputes amicably.

Jurisdiction and Venue

Any disputes that cannot be resolved informally shall be resolved in the appropriate state or federal courts located in the jurisdiction where Awaken Guardians maintains its principal place of business. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

Entire Agreement

These Terms of Service, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Awaken Guardians regarding your use of our services and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights and obligations under these Terms without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section shall be null and void.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
